Terms of Service

By using 1 Call Away ("the Service"), you agree to these terms. If you don't agree, please don't use the Service.

1. What we provide

1 Call Away operates a pay-per-minute phone line where callers speak with an AI companion named Aria. When you call the service number, your call is answered by an artificial intelligence system — not a human. This is made clear on our website, in our marketing, and in a disclosure message at the start of each call.

    Aria is an AI. If you ever directly ask during a call whether Aria is a human, she will confirm that she is not.
  

2. Eligibility

You must be at least 18 years old to use the Service. By registering, you confirm that you are an adult and capable of entering into a binding agreement under the laws of your jurisdiction.

3. Account and registration

To place calls billed through the Service, you must register an account and provide:

A valid email address
The phone number you intend to call from
A valid credit or debit card, processed by our payment provider (Stripe)

You are responsible for keeping your account credentials and payment information accurate and up to date.

4. Pricing and billing

Calls are billed as follows:

The first 30 seconds of every call are free.
After 30 seconds, calls are billed at $1.99 per minute, rounded up to the nearest whole minute.
Charges are processed after the call ends and appear on your credit card statement as "1CA Services."
Standard carrier rates for placing the call may apply separately, depending on your phone plan — these are not charged by us.

Prices may be updated with notice. Continued use of the Service after a price change constitutes acceptance.

5. Refunds

Because calls are billed per minute and delivered immediately, we do not generally offer refunds. If you believe you were charged in error (for example, a technical failure that caused the service not to work), contact us within 14 days and we will review your request.

6. Acceptable use

You agree not to use the Service to:

Attempt to manipulate, confuse, or "jailbreak" the AI into producing harmful, illegal, or sexually explicit content
Record, retransmit, or publish calls without clearly disclosing that you are doing so
Harass, threaten, or attempt to deceive other people using information obtained through the Service
Use the Service for any illegal activity
Attempt to reverse engineer, scrape, or otherwise interfere with the operation of the Service

We reserve the right to suspend or terminate accounts that violate these rules, without refund.

7. Not a crisis service

1 Call Away is a conversational companion service. It is not a substitute for professional mental health care, medical advice, legal advice, or emergency services. If you are experiencing a mental health crisis, please contact a qualified professional or call the 988 Suicide & Crisis Lifeline (available 24/7 in the United States) or your local emergency number.

8. No guarantee of continuous availability

We aim for high uptime but cannot guarantee the Service will always be available. Maintenance, outages at our telecom or AI providers, or other events may cause temporary unavailability. We are not liable for damages arising from unavailability.

9. Intellectual property

All content, trademarks, and technology associated with 1 Call Away — including the "Aria" persona, voice, and conversational style — are owned by us or our licensors. You receive a limited, non-transferable right to use the Service for personal, non-commercial purposes only.

10. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim arising from your use of the Service is limited to the amount you paid us in the 90 days prior to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or emotional distress.

11. Changes to these terms

We may update these terms from time to time. If we make material changes, we'll notify you by email and post the updated terms here. Continued use after the effective date means you accept the updated terms.

12. Governing law and disputes

These terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles. Any dispute will be resolved through binding individual arbitration, except that either party may bring a claim in small-claims court for qualifying disputes.
